User Agreement

This User Agreement (“Agreement “) is a legal agreement between you (referred to as “you” or “Customer”) and Best Otsukai Errander (“BOE” or “us “). This Agreement governs your use of the BOE website, referred to in this Agreement as “BOE.com” or the “Site,” and BOE services. All services provided by BOE are described in BOE.com and are collectively referred to in this Agreement as “Services.” 
 

This Agreement supplements the terms and conditions of the Services described in the Site. By accessing the Site or opening a new account with BOE.com, you agree to be bound by and hereby become a party to all the terms of this Agreement.
 

Please read the entire terms and conditions of use carefully before you use BOE.com. If you do not agree to all the terms and conditions, you may not use the site. By using the site, you are deemed to have read and accepted these terms and conditions.

Costs
The costs for the Best Otsukai Errander (“BOE”) services are listed on Plans and Fees at https://www.boe-errander.com/en/plans-and-pricing

 

Registration
Before you use the Services, you must open a BOE Account by completing the BOE Account Set Up form with true, accurate, current and complete information about yourself (the “Registration Information”). You agree to maintain and update the Registration Information to keep it true, accurate, current and complete.


Account Verification
The following information are required at the time of registration to process the Identity Verification which has been mandated by the Japanese government to all package forwarding agents from 1st April, 2013.

-Your name
-Your date of birth
-Your current address
 

Billing Problems
Customer is responsible for reviewing all charges from BOE. Any suspected discrepancies in billing must be reported to BOE within 7 days of the billing date. After 7 days, no charges are refundable.
 

Shipping
BOE ships by the shipping method between UGX, EMS, AIR, SAL and SURFACE (Boat) offered by JAPAN POST. Each shipping method has size and weight limits. We will inform you of options of shipping methods available and the cost of each method which includes cargo tracking and insurance covering the full purchase prices of the goods.

Upon your request, we also ship packages to your contracted forwarder.
You can also request your orders shipped freight collect on your DHL/ FedEx account.
 

BOE is not responsible for the actual shipping service that is chosen by you. All terms and conditions of the selected shipping service (EMS, DHL/ FedEx, etc.) apply to you. 

You authorize BOE to open packages if there is a suspicion about content of the package (illegal goods) or any practical reason.
 

Photographs of Packages
Upon your request, BOE will open and photograph the contents of a package, allowing you to confirm the merchandise is correct and in good condition before requesting mailout.
 

Consolidation
Items delivered to BOE in several shipments can be consolidated in one package as long as the size and weight of all products are informed by the sellers prior to invoicing the shipping costs to you, and the package falls within JAPAN POST's weight and size limits.
 

Consolidation packing fees will be charged separately.
 

Unless you request otherwise, we will remove all catalogs during consolidation. Catalogs add to shipping costs, and most customers want them removed.
 

Customs duties/ taxes
Customs duties/taxes may be imposed depending on the country of destination or contents and declared value of a carriage. BOE fees don't include customs duties/taxes, which must be covered by the recipient.
 

Refunds
No amount is refundable except for reimbursement for damage, disappearance, or loss of parcels that may occur during transportation by JAPAN POST.
 

Missing and Lost Packages
In the case of a lost or damaged package, it is compensated in accordance with the indemnification policy of JAPAN POST.
 

Prohibited Items
BOE cannot assist purchases of both goods which are universally prohibited to ship from Japan to any country and goods which cannot be shipped to countries designated as a destination. You must ensure that the goods you are requesting BOE to purchase on your behalf are not included in the list of prohibited/restricted items which cannot be shipped to the country of destination.

BOE will not bear any responsibility if it is discovered that the goods cannot be sent to the destination at the time of shipment. If you wish to return the goods to the Seller and the Seller accepts your request and agrees to refund, BOE will process the return and refund you the amount from which return shipping and handling charges are deducted. If the seller does not accept the return of the goods or no reply is received from you within 10 days, BOE reserves the right to dispose of the goods.
 

Unclaimed Packages
Carriers may choose to dispose of a package a) in the event they are unable to contact you via text or email after multiple unsuccessful delivery attempts, or b) you are unwilling to pay all required fees, duties, and taxes. To ensure the carrier is able to contact you for delivery, please ensure your email and cellphone number are up-to-date.
 

Assisted Purchases
BOE can assist you to purchase products in Japan. However, we are not responsible for quality of the goods, warranties, delivery issues, back up orders, etc. BOE is not responsible if the purchase cannot be made for any reason.

Membership

A "member" is any party that has agreed to the Terms, completed an online membership application to use the Service run by BOE had their membership approved by BOE and been issued with a member ID.

Members may not allow any third party to use their membership, lend, transfer, sell or pledge their membership to a third party or engage in any form of equivalent conduct.
 

Revisions to Terms of Service
From time to time and as needed or required by law, we will amend, modify, or change the terms of this Agreement by making those changes directly to the Agreement on this Site. These changes take effect when posted to the site. By continuing to access or use BOE.com after any such amendment, you agree to be bound by the terms of the amended Agreement.
 

Membership applications

  1. Those wishing to become members (hereafter referred to as "prospective members") shall complete the online membership application form in person.

  2. Membership registration procedure shall only be completed once BOE has approved the application outlined in the preceding paragraph. Membership may be declined however if BOE deems that any of the following grounds are applicable to the prospective member. Membership may also be revoked after approval if any of the following grounds are deemed to be applicable.

    1. In the case that the prospective member is a minor and has not obtained the consent of a parent or guardian

    2. In the case that the prospective member is ineligible for membership due to a previous breach of the Terms or other such reason

    3. In the case that the details provided by the prospective member on their application are found to be untrue, incorrect, or incomplete

    4. In the case that the prospective member has neglected to make payment of outstanding obligations to BOE

    5. In the case of any form of conduct liable to interfere with or otherwise impact upon the running of BOE, the provision of the Service or the usage of the Service by other members

    6. In the case of any other conduct deemed inappropriate by BOE

 

Member ID and password management

  1. Members shall be responsible for managing the member ID and password issued to them by BOE after membership registration.

  2. Members may not allow any third party to use their member ID or password, lend, transfer, sell or pledge their member ID or password to a third party or engage in any form of equivalent conduct.

  3. Members shall be liable for any losses or damage resulting from the inadequate management, inappropriate usage or third party usage of their member ID and password or any form of equivalent conduct. BOE shall accept no liability whatsoever in such an event. All usage of the Service via a member ID and password shall be attributed to the relevant member, who shall be held fully responsible.

  4. If a member ID or password has been divulged to a third party or there is a risk of a member ID or password being used by a third party, the relevant member shall inform us immediately and proceed as instructed. If BOE sustain any losses or damage because of the unauthorized usage of a member ID or password, the relevant member shall compensate BOE accordingly.

  5. Members are under obligation to change their password on a regular basis. BOE shall accept no liability whatsoever for any losses or damage sustained because of members failing to fulfill such obligations.
     

Cancellation of membership

  1. Members are entitled to cancel their membership by following the procedure specified by BOE.

  2. In the event of the death of a member, BOE shall cancel the relevant member’s membership immediately and suspend usage of their member ID and password.
     

Suspension or termination of membership
BOE may temporarily suspend or terminate any member's membership with no prior notice or warning if any of the following grounds are applicable.

  1. In the event of unauthorized usage of the member's ID or password to access the Service or if the member allows such actions to take place

  2. If the member fails to make payment of charges by the specified date

  3. In the event of that the member has proceedings filed against them, including seizure, provisional seizure, provisional injunction, compulsory execution, bankruptcy or civil rehabilitation, or files for such proceedings themselves

  4. If the member has incorrectly entered their password on more occasions than permitted by BOE

  5. If the member has not used the Service for a period specified by BOE

  6. If the member has breached other provisions set out in the Terms or separate terms

  7. If BOE deems the relevant party to be ineligible for membership for any other reason
     

Handling of personal data

  1. BOE shall handle the Purchasing Member's personal information in accordance with the Privacy Policy separately established by BOE, and the Registered Member shall agree to this.

  2. In applying to use the Service, the Registered Member agrees that the Member's personal information will be provided to the seller of the product to the extent necessary to provide the Service to the Member.
     

Service charges and payment

  1. Charges for using the Service are as indicated on the service price list and may be revised by BOE with no prior notice.

  2. Members shall make payment of all service charges as instructed no later than the date specified by BOE.
     

Inspections

  1. BOE may open packages and inspect the contents. However, we are under no obligation to carry out such inspections and inspection results do not represent a guarantee of any sort regarding the quality of the relevant product, the presence or absence of defects, authenticity or the occurrence of any violation of applicable legislation in the country of origin, or destination or intermediate countries.

  2. If an inspection, as outlined in the preceding paragraph, brings to light any items that are in violation of or are suspected of being in violation of the Law for Prevention of Transfer of Criminal Proceeds or other applicable legislation, BOE may take steps such as notifying the police or other government agency or surrendering the items in question.

  3. BOE shall accept no liability for any losses or damage sustained by the member because of product inspections or any other actions stipulated in this article.

 

Refusal to provide the Service
If any of the following grounds are applicable or are suspected to be applicable, BOE may refuse to provide the Service, even if the Service has already been accepted.

  1. If the product concerned is listed under “Products excluded from the Service”

  2. If it is not possible to verify the member’s address or the product delivery address

  3. If the member has rejected the product

  4. If the carrier will not deliver the product

  5. If the product is seized by customs

  6. If the member fails to make payment of service charges

  7. If the member has breached the Terms

  8. If the provision of the Service is deemed to be inappropriate by BOE for any other reason
     

Changes to or the suspension of the Service
BOE may make changes to the contents of or suspend the Service without prior notice. BOE shall accept no liability for any disadvantages experienced or losses or damage sustained by the member because of such changes or suspension.

 

Interruptions to or the suspension of the Service

  1. If any of the following grounds are applicable, BOE may interrupt or suspend all or part of the Service with no prior notice to members.

    1. If equipment or systems used for the provision of the Service are undergoing maintenance checks or being replaced

    2. If it is unfeasible to provide the Service due to a fire, power failure, natural disaster, system failure or other such factor

    3. If telecommunications carriers are failing to provide essential services

    4. If BOE deems it necessary to interrupt or suspend the Service for any other reason

  2. BOE shall accept no liability whatsoever for any losses or damage sustained by members because of interruptions to or the suspension of the provision of the Service.

 

Prohibited conduct

  1. Members shall not engage in any of the following forms of conduct or any form of conduct that could potentially be regarded as such in relation to their usage of the Service.

    1. Using the Service for unauthorized purposes

    2. Infringing upon intellectual property rights (trademark rights, copyrights, design rights, patent rights, etc.), portrait rights, publicity rights or any other rights belonging to BOE or a third party

    3. Engaging in conduct linked to fraud or other criminal activities

    4. Impersonating a third party to use the Service

    5. Using facilities belonging to BOE or a third party without authorization or otherwise impeding the running of BOE or a third party

    6. Breaking the law, violating the Terms or separate terms or causing offense to public order and morals

    7. Interfering with the running of the Service

    8. Engaging in any other form of conduct deemed inappropriate by BOE

  2. If BOE sustains any losses or damage because of a member violating the Terms or separate terms, we may claim compensation against the relevant member accordingly.
     

Elimination of Anti-Social Forces

  1. A Member shall represent that it does not fall under any of the following items as of the date of execution of the contract and promise that it will not fall under the same in the future.

    1. An organized crime groups.

    2. A member of an organized crime group.

    3. An associate member of an organized crime group.

    4. An affiliate of an organized crime group.

    5. A professional troublemaker at stockholders' meetings, etc., a racketeer, etc. who professes to be engaged in a social movement, or a crime group specialized in intellectual crimes.

    6. A person having a social or economic relationship with any person who falls under any of Item (1) through Item (5) of this paragraph.

    7. Otherwise, a person equivalent to any of the preceding items.

  2. A Member shall promise not to perform any of the acts which fall under the following items.

    1. An act of making violent demands.

    2. An act of making unreasonable demands exceeding lawful responsibility.

    3. An act of impairing the credibility or interfering with the business of the opposite party in relation to transactions using fraudulent means or the use of force.

    4. Otherwise, any act equivalent to any of the preceding items.

  3. If an opposite party Member falls under any of the items in Paragraph 1 or has performed any act which falls under any of the items in Paragraph 1, or if it has been discovered that an opposite party Member has made a false declaration concerning the representation and promise pursuant to the provisions of Paragraph 1, BOE may terminate a contract with such an opposite party Member.
     

Governing law and jurisdictional court

  1. The Terms and separate terms shall be subject to Japanese law.

  2. In the event of any dispute regarding the Terms or separate terms, exclusive and primary jurisdiction shall rest with Tokyo District Court.
